Public Statement by Krautungalung Elder, Uncle Robbie Thorpe, regarding Genocide Prosecution of Mark Regev

9th October 2024 – Uncle Robbie Thorpe and Daniel Taylor are prosecuting Mark Regev (Benjamin Netanyahu’s Senior Advisor for Foreign Affairs and Communication) in the Magistrates Court in Melbourne. Regev is being charged with Advocacy for Genocide, section 80.2D of the Australian Criminal Code, for public comments advocating for Genocide of the Palestinian people in the Australian Media.

“I find it offensive that this country that committed genocide against us is now allowing our country to be used as a base to advocate genocide against Palestinian people…How Australia responds to the Genocide Convention is important to me, considering it wasn’t an offence until recently. Colonial Australia has failed to prevent genocide, and they have failed to punish anyone for these crimes here, or anywhere, despite the 1948 Genocide Convention. This is a significant case because it is engaging the act, and no person is immune – not the King, not the Prime Minister, Attorney Generals, nobody, not anybody is immune from being prosecuted on genocide charges. This case opens the door for Aboriginal genocide claims around this continent, and elsewhere around the world, for anybody.

Australia has been reluctant, unwilling and incapable of dealing with these issues. I hope this will allow people access to address these fundamental issues of international law, the crime of genocide and the most heinous crimes against humanity. You’ve got to stop genocide in your own back yard. No complicity, no contributing. If you’ve got gun running operations in your community, stop them…we don’t want people running guns out of here killing people on the other side of the world. They’re using this as a launchpad, a military outpost to do their dirty work. I know these illegal occupations here and in Palestine are guilty of these acts, there’s no doubt about it. Our sovereignty, human and inherent rights are not up for foreign democratic decisions and voting. This is our land and law, just recognize that, stop the denial, unwind all the institutionalized racism, stop with the delusional notions of superiority.

Here, the deaths in custody continue, it’s getting worse, the removal of children is getting worse, the conditions of life are getting worse, right across the board things are getting worse. The whole Convention for the Prevention and Punishment of the Crime of Genocide is in breach, every aspect, it’s not just me saying it, reports from UN rapporteurs over many years, royal commissions, inquiries by the state itself all concur, it’s out of control. The international community can’t say they didn’t know. It’s such a clear example of genocide here and
it’s on a grand scale. No more excuses. Our lands are resource rich, there is much wealth and power here, our land is isolated and has become a safe haven of British colonial domination. We have a foreign head of state, we are not free or independent, we are stopped at every turn when it comes to self-determination, human rights, justice. It ends now, not when the invaders, trespassers, strayaliens are ready. Now, today! We want our day in court, we want this illegal occupation brought to account.

Today is important, we as First People need to be able to utilise the Convention and ICCJ, it’s critical. The Australian state has been unwilling and in denial. It’s clear that British colonial Australia is reluctant, unwilling and incapable of addressing the issues, meanwhile we suffer. Colonial Australia has no consent to occupy our land, no treaties, obviously no jurisdiction for 254 years of the denial of our existence, laws, human rights has been our lot, we demand relief, justice, recognition, restoration and restitution for these ongoing crimes against our humanity. Enough is enough, this illegal occupation needs to be put in its place, the international legal community need to intervene. So much for “never again”, we all know “evil reigns when good people do nothing”. Where does the rest of the globe stand on all this? Who’s complicit in the crimes here? This continent represents many independent, self-determining sovereign countries, we want our stories told, we want an authority that is unbiased, independent, impartial. These matters are and always have been extremely urgent, it’s time to act!

We know there’s a parallel between genocide, ecocide, suicide, and that affects everyone and everything. This unprovoked, undeclared, secret war and invasion needs to end now, and the international legal community need to step up. It starts right here, right now. Don’t leave it for future generations, we all need to take responsibility for the future generations, our lands, cultures and environments. Time for an official end of hostilities. It’s offensive and insulting to be talking now about state-based solutions, treaties, truth commissions. We want international scrutiny, we owe it to our ancestors, our esteemed elders, our sacred land, all that comes with that and our children’s, children’s children, everyone’s children.
